Public Interest Disclosures Act 2022 – LALC Model PID Policy

25 June, 2024

The Public Interest Disclosures Act 2022 (PID Act) applies to all NSW public sector agencies. The PID Act provides a framework for Public Officials to report serious wrongdoing in the public sector, and to be protected when they do so.

Under the PID Act the following people are deemed as Public Officials:

  • Staff and Councillors of NSW Aboriginal Land Council (NSWALC)
  • Staff, Voting Members and Board Members of Local Aboriginal Land Councils (LALCs)
  • Volunteers, Contractors and Subcontractors who provide services or exercise functions on behalf of NSWALC or LALCs.

Wrongdoing may include corrupt conduct, serious maladministration, and not abiding by proper procedures and policies. “Serious wrongdoing may be driven by personal gain or by benefiting others in ways that are not in the interest of the organisation.

Under the Act, all agencies, including NSWALC and LALCs, must have a PID Policy. The policy must be available on websites, intranets, and/or Social Media sites.

To assist LALCs in meeting their requirement to have a PID Policy, NSWALC has developed a template to support LALCs in developing their own PID. Download: Model PID Policy for LALCs.
